ApplicantPro ("ApplicantPro", "we", "us" or "our") is committed to the privacy and security of your personal information and is committed to complying with this privacy policy ("Privacy Policy" or "Policy"). The goal of this Policy is to provide you with a clear understanding of information we collect about you, how we collect it, how we use it, with whom we share it and what choices you have regarding our use of your information.

This Privacy Policy applies to all ApplicantPro websites and collective services that link to this Policy (collectively, our "Sites").

If you do not agree with our policies and practices, your choice is not to use our Sites. By accessing or using the Sites, you agree to this Privacy Policy.

Privacy Policy Updates:

We may change this Privacy Policy at any time and from time to time. The most recent version of the Privacy Policy is reflected by the effective date located at the top of this Privacy Policy. All updates to this Privacy Policy are effective immediately upon notice thereof, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on our Sites.

We reserve the right to make any changes to this Privacy Policy at any time. The version of this Privacy Policy posted on our Sites on each respective date you visit our Sites will be the Privacy Policy applicable to your access and use of our Sites on that date. Our electronically or otherwise properly stored copy of this Privacy Policy will be deemed to be the true, complete, valid, and authentic copy of the version of this Privacy Policy in force on each respective date you visit our Sites. This Privacy Policy is our notice to you and does not constitute a contract between you and us.

Information We Collect About You and How We Collect it:

Information we collect on our Sites: We may collect certain information from or about you in connection with your use of, or your submissions to, our Sites, as described in this Privacy Policy ("Collected Information"). Collected Information includes, without limitation, any information that may be used to identify an individual, including, but not limited to, first and last name, a physical address, phone number, email address, usernames, passwords and passively collected information, such as cookie data and an IP address, as described below. This information is typically collected when you request a price quote, trial, demonstration or request to sign up for services provided by us. This information will be used only by us to provide you with the requested services and support needed.

Information Collected Automatically:

By placing a small file known as a "cookie" on your computer (or other device), ApplicantPro and its third-party service providers' servers passively gather information about all visitors' use of our Sites as permitted by applicable law, including statistics collection and analysis, website optimization, analytics (as described below), market research and maintenance of user login information.

The information that we and our third-party service providers track with cookies includes, but is not limited to, the type of browser (such as Google Chrome or Internet Explorer) and Internet-connected devices being used to access our Sites, your Internet protocol ("IP") address, your home domain or Internet service provider, your referrer URL (which is the URL for the website that you were viewing prior to visiting our Sites), how you were directed to our Sites, which specific pages you access on our Sites, how long you view each page, the time and date you access our Sites and the total number of visitors to our Sites and any portions thereof.

We, and our third-party service providers, may use the information collected from cookies or similar files on your computer for security purposes (such as authentication), to facilitate site navigation and to personalize your experience while visiting our Sites. This data helps us, and our third-party service providers, improve our respective products and services.

Most popular Internet browser applications will allow you to configure the browser so as not to accept cookies. However, setting your browser to reject cookies may, in certain instances, prevent you from taking full advantage of our Sites (or some portion thereof) and its capabilities, or cause some features of our Sites to function improperly or more slowly.

How ApplicantPro Uses Your Data from Our Sites:

By using our Sites, you are automatically opted-in to share applicant content and information with its affiliates, partners and associated third parties. ApplicantPro shares information for reasons including, but not limited to, improvement of our services, products and features, better protect our users, better understand their needs and to optimize the services and experience of our users. The services provided to you and the functionality of the Sites could not be provided without such sharing. If you do not wish your information to be shared in this way, you should not use the Sites.

How We Use Your Information:

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Sites and its contents to you.
  • To provide you with information, products or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including billing and collection.
  • To notify you about changes to our Sites or any products or services we offer or provide through it.
  • To personalize your Sites experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Sites, third-party sites, and via email or text message (with your consent, where required by law).
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We may also use your information to contact you about goods and services that may be of interest to you. You will have an opportunity to opt out of the goods and services offered when you receive the information. We may use the information we have collected from you to enable us to display advertisements to our advertisers' target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Data Security:

ApplicantPro has implemented commercially reasonable measures designed to secure and protect information transmitted via or stored on our Sites and our related systems from unauthorized access, use, alteration and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Sites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Sites like message boards. The information you share in public areas may be viewed by any user of the Sites.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Sites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites.

User Profile and Applicant Information Use

If you choose to create a profile with ApplicantPro and choose to submit application(s) containing Personal Information using the Site, you are applying for a position with a specific company that is a client of ApplicantPro and are giving consent to process the Personal Information included in your application and profile. By providing the information within your user profile and employment application to ApplicantPro, you understand and agree that your information will be shared to the company you are applying to. Although your ApplicantPro user account (that includes your name, address, phone number and email address) is used to link your various applications across multiple companies who use ApplicantPro, the company users are only able to see the specific application that you submitted to them. They cannot see information that you submitted on applications to other employers or see that you have applied to other jobs outside of their company.

ApplicantPro may also share this information with its partners, affiliates and third parties for the purposes of providing additional jobs services related to the purpose for which you provided the information.

It is up to each individual company to decide how they will use the information that you submit as part of the application process. Please be aware that once you submit an application using the Site, ApplicantPro does not maintain complete control over who has access to, and what they do with the information submitted on your application(s). The personal information you submit to any of these third-party sites, including the registration for job alerts, is governed by their privacy and security policies.

Linked Websites:

For your convenience, some hyperlinks may be posted on our Sites that link to other websites not under our control. We are not responsible for, and this Privacy Policy does not apply to, the privacy practices of those sites or of any companies that we do not own or control. We do not endorse any of these websites or pages, the services or products described or offered on such sites or pages, or any of the content contained on those sites or pages. We encourage you to read the privacy policy of each website that you visit. In addition, should you happen to initiate a transaction on a website to which our Sites link, the information that you submit to complete that transaction becomes subject to the privacy practices of the operator of that linked website.

Agreement for Communication:

By filling out a form on our Sites, you are requesting and providing consent to be contacted by us regarding our products and services. This communication may come in the form of phone calls, emails, postal service mail, or even text messages.

Data Retention:

We will retain the information associated with your user profile as long as your user account is active. Specific applications submitted to various companies using ApplicantPro will be retained by the employers based on their own data retention policies. We do not maintain complete control over the length of time a company keeps applications on file, and this may vary from company to company. Our clients may choose to keep applications on file as they deem reasonably necessary.

Children's Privacy:

Our Sites are intended for a general audience and is not intended for use or view by children under 13 years of age without parental consent, and we do not knowingly collect information about children or sell products to children. Consistent with the Children's Online Privacy Protection Act, we will not knowingly collect any information from children under the age of 13. Please email privacy@applicantpro.com if you have information about personal information being collected for children under the age of 13.

Job Applicants:

Any personal information you provide us with when applying for a career position with us will be used to consider and act upon your application. We may retain your personal information for a period of time, but only for as long as necessary for such purposes. We may disclose your personal information to our agents for the purpose of evaluating your qualifications for the particular position you applied for, or other available positions. We may also disclose your personal information to third parties hired by us to collect, maintain, and analyze candidates for career positions.

Use of Artificial Intelligence (AI):

It is imperative that any use of AI that is performed by ApplicantPro employees is done appropriately, responsibly, and ethically. Your State Privacy Rights:

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. See below California's privacy policy information.

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  1. Confirm whether we process their personal information.
  2. Access and delete certain personal information.
  3. Data portability.
  4. Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  1. Correct inaccuracies in their personal information, taking into account the information's nature processing purpose.
  2. Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

ApplicantPro Privacy Policy GDPR

Residents of the European Union (EU) have additional rights set forth by the EU General Data Protection Regulation (GDPR). Although GDPR is intended to protect the personal data of those in the EU, these data management options are available to any users. Should you wish to receive an electronic copy of your data or request the removal and erasure of your personal data pertaining to any applications you have submitted through our sites or your user profile, you may do so by emailing privacy@applicantpro.com or call us at 888-633-9269.

The removal of your user profile will permanently delete any information we have stored for you including any applications you have submitted to employers through ApplicantPro. The employers will be notified of your request to delete your applications and all personal data they may have stored outside of our platform in the processing of your information.

ApplicantPro Privacy Policy for California Residents

This ApplicantPro Privacy Policy is for California Residents ("Policy") and supplements the information contained in ApplicantPro's Privacy Policy and is adopted to comply with privacy rights law of California. California residents can find more information about consumer privacy at https://oag.ca.gov/privacy/consumer-privacy-resources. The Policy applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you").

Privacy Notice and Information We Collect:

When you visit any of our Sites (as defined in ApplicantPro Privacy Policy), ApplicantPro ("ApplicantPro", "we", "us" or "our") may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer (you), household, or device ("Personal Information"). Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from California consumer privacy laws, like:
    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA), clinical trial data, or other qualifying research data;

Your Personal Information may be collected to support ApplicantPro business operations and for website optimization, however ApplicantPro does not sell your Personal Information. Selling does not include Applicant performing services on behalf of a client or other person or entity.

We may use and disclose certain aggregated, anonymized information, such as website usage data, to our trusted business partners. Such information may also be shared with other users or the public for advertising, informational, or comparison purposes.

We may also disclose information collected if it becomes subject to a subpoena or court order, or if it is otherwise legally required to disclose information. We may also use and disclose collected information as required or permitted by applicable law, including to establish or exercise our legal rights, to enforce the Terms of Use, to assert and defend against legal claims, or if we believe such disclosure is necessary to investigate, prevent, or take other action regarding actual or suspected illegal or fraudulent activities or potential threats to the physical safety or well-being of any person.

As ApplicantPro grows and develops its business, it is possible that its corporate structure or organization might change or that it might merge or otherwise combine with, or that it or portions of its business might be acquired by, another company. Under such circumstances, website information generally is, and should be expected to be, one of the transferred business assets. Further, if any bankruptcy, liquidation, or reorganization proceeding is brought by or against ApplicantPro, certain information may be considered a company asset that may be transferred to third parties.

Sharing Personal Information:

We may share your Personal Information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the Personal Information confidential, and prohibit using the disclosed information for any purpose except performing the contract. Choices About How We Use and Disclose Your Information:

At ApplicantPro, we strive to provide you with choices about the personal information you provide to us. The following are ways you can exercise control over your information. Also, this section describes your CPRA rights and explains how to exercise those rights.

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Disclosure of Your Information to Third-Party Advertising. ApplicantPro will not sell or share your personal information with unaffiliated or non-agent third parties for promotional purposes.
  • Promotional Offers from ApplicantPro. If you do not wish to have your contact information used by ApplicantPro to promote our own or third parties' products or services, you can opt-out by sending us an email at privacy@applicantpro.com stating your request.

ApplicantPro does not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the "right to know"). For general information, please see the charts above. For more detailed requests, once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will disclose to you specifics about:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
  • The specific pieces of personal information we collected about you (also called a data portability request).

Right to Delete

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Your Rights to Know or Delete

To exercise your rights to know or delete described above, please submit a request by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. To designate an authorized agent for the purposes described in this Policy, email privacy@applicantpro.com.

You may also make a request to know or delete on behalf of your child by sending an email to privacy@applicantpro.com.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
    • Power of attorney
    • Other lawful binding documentation allowing a representative to act on your behalf.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in the request to verify the requestor's identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact 888-633-9269 or email privacy@applicantpro.com.

ApplicantPro will generally provide a substantive response to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, and it is an option, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your consumer privacy rights under the laws of California. Unless permitted by the California, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Other California Privacy Rights

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Changes to Our Privacy Policy

We reserve the right to amend this privacy policy at our discretion and at any time. When we make changes to this privacy policy, we will send an email informing you of the change. It is your responsibility to make sure your contact email and information is up to date with ApplicantPro.
